1. Eligibility

You must be at least 18 years old or of legal age in your jurisdiction to use this Service. By using the Service, you confirm that you meet this requirement and that all information you provide is accurate and complete.

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password.
• Notify us immediately of any unauthorized access.
• Be responsible for all activities under your account.

3. Service Description

Our platform enables you to connect eCommerce stores (e.g., Shopify, WooCommerce), import and list products, manage customer orders, and fulfill them through third-party logistics. We act as a technology intermediary and are not the supplier or manufacturer of listed products.

4. Store Integrations

When connecting third-party services, you grant us access to data necessary to operate. You are responsible for complying with third-party terms and ensuring lawful data sharing. We are not liable for third-party service issues.

5. Product Listings

Products are sourced from external suppliers. We make no guarantees regarding availability, accuracy, or compliance. You are responsible for verifying product details before publishing to your store.

6. Order Fulfillment and Shipping

We facilitate fulfillment through third-party providers. Delivery estimates are not guarantees. We are not liable for shipping delays or losses. You must communicate clear shipping expectations to your customers.

7. Fees and Payments

You agree to pay all applicable charges per our Pricing Plan.

• You must provide valid payment information and maintain good standing. Access may be suspended for non-payment.
• 100% of the product purchase cost must be paid in advance to confirm an order.
• Shipping fees, delivery charges, and payment gateway charges are strictly non-refundable.

8. Refunds and Liabilities

• Fees collected by third-party payment services or integrated stores are non-refundable.
• Refunds always follow the policies of the original seller/marketplace. MoveDrop will refund only if the seller approves. MoveDrop is not responsible for errors, delays, or rejections in seller refunds.
• Refunds for product mismatches (wrong color, quantity, or quality issues) are limited to the approved purchase value. Shipping, tax, and service fees are non-refundable.
• In cases of natural disasters, pandemics, lockdowns, or unavoidable delays, refund eligibility depends solely on the seller's decision. If the seller denies a refund after the allowed timeframe, MoveDrop will not be liable.
• For fragile items (e.g., glassware, ceramics, fishing kits), refunds are not guaranteed. Orders for such items are placed at the customer's own risk. If the seller agrees, partial refunds may apply.
• If a shipment is lost or wrongly delivered, MoveDrop may consider partial refunds depending on circumstances. The final decision rests jointly with the seller and MoveDrop.
• Certain products (e.g., cosmetics, medicines, electronics) may require government permits for international shipping. Refunds may be limited or denied in such cases.
• All refund-related decisions jointly made by the seller and MoveDrop will be considered final and binding.

9. Prohibited Uses

You may not use the Service to:

• Sell illegal or counterfeit products.
• Violate laws or regulations.
• Engage in fraud or harassment.

Violations may result in suspension or termination.

10. Intellectual Property

All content and branding are owned by or licensed to us. You may not copy, modify, or redistribute any portion of the Service without permission.

11. Termination

We may suspend or terminate your account for violating these Terms. You may cancel your account via your dashboard or by contacting support.

12. Disclaimers

We do not guarantee uninterrupted access, product availability, or accuracy of information.

13. Limitation of Liability

We are not liable for indirect or consequential damages arising from your use of the Service.

14. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance.

15. Data Protection and Processing

• Roles and Use of Data: MoveDrop acts as a Data Processor, and the Merchant acts as the Data Controller for any personal data of customers. MoveDrop only processes personal data to provide services (store integrations, order management, fulfillment, and delivery) and never sells or uses it for its own purposes.
• Security and Compliance: MoveDrop uses industry-standard security measures (encryption, secure access controls, monitoring) to protect personal data. If third-party providers (e.g., hosting, shipping carriers) are used, they are bound by similar data protection obligations. MoveDrop assists Merchants in handling data subject rights requests (access, correction, deletion).
• Breach Notification and Data Deletion: If a data breach occurs, MoveDrop will promptly notify affected Merchants. Upon termination of services or request, all personal data processed on behalf of Merchants will be securely deleted or returned within 30 days, unless retention is legally required.

16. Third-Party Products and IP Responsibility

All products made available through our shopping agent service are sourced from third-party eCommerce platforms. MoveDrop does not directly sell these items and therefore disclaims liability and legal responsibility for any issues related to intellectual property rights, product authenticity, or copyright infringement. Users are responsible for verifying product legitimacy prior to publishing or selling.

17. Prohibited Items

The following types of products are strictly prohibited:

• Alcohol, tobacco, cannabis, and related items
• Gambling products
• Illegal drugs, medications, or unapproved medical devices
• Weapons, ammunition, explosives, and hazardous materials
• Human body parts or fluids
• Adult content or explicit sexual material
• Products involving animal abuse or derived from endangered species
• Digital currencies, NFTs, or unregulated investment products
• Items promoting hate, violence, discrimination, or illegal activity
• Offensive, obscene, or otherwise inappropriate content

If we detect such prohibited products in your listings or orders, we will be unable to fulfill or ship them under any circumstances.
